Call for Papers: LAMB Research Network Junior Scholars' Workshop in Behavioral and Experimental Law and Economics at Notre Dame in Dublin

The Notre Dame Research Program on Law and Market Behavior (ND LAMB) is convening a junior and senior scholars' conference in behavioral and experimental law and economics at Notre Dame's global gateway in Dublin, Ireland on July 17-18, 2014.

This unique event aims to bring together junior researchers, advanced Ph.D. candidates, postdocs, and junior faculty to present their ongoing research to an audience of their peers and a select group of senior scholars in these fields. During the conference, participants will receive feedback on their work, suggestions for future research, and an opportunity to network with like-minded researchers.

Professor Mark McKenna has Recently Published a New Article, Progress and Competition in Design

Professor Mark McKenna (with Katherine Strandburg), has recently published, Progress and Competition in Design, Stanford Technology Law Review, Vol. 17, (2013). This article argues that applying patent-like doctrine to design makes sense only if a design patent system is premised on a patent-like conception of cumulative progress that permits patent examiners and courts to assess whether a novel design reflects a nonobvious step beyond the prior art. If there is a meaningful way to speak of such an inventive step in design, then design patent doctrine should be based on that conception. If nonobviousness has no sensible meaning in design, then a patent system cannot work for design. Read article
